For transactions in PEXA, the required details for this form are entered by the incoming owner when the transfer is created, and the form is displayed as a second page when the rendered transfer is displayed. From May 2018, transfers in which an acquirer is registered as a trustee can be processed via eConveyancing. To make this possible, a new practice has been introduced regarding fiduciary documentation – a certified copy of the trust deed is no longer required and only the details of the trust are required. For consistency in paper form, the Register of Securities introduced a new trust details form (in a Form 20 – Schedule) in May 2018, which can be used as an alternative to filing the full trust deed. The new form can be used when submitting a transfer from Form 1 that includes an acquirer as trustee in point 5. If an incoming mortgage debtor is involved, the details entered in the transfer, which indicate that the purchaser/new owner as trustee, are passed on at the creation of the mortgage and indicate the assets of the assignee or mortgage debtor as “trustee”. .
